Where applicable, you may be required to agree to additional terms, waivers, and policies provided by those third parties. Champagne Yacht may act as a marketing partner, facilitator, or booking coordinator depending on the offering described.
Payments, deposits, cancellations, and refunds
Payment terms, deposits, cancellation rules, rescheduling options, and refund eligibility may vary by yacht, date, crew, season, and operator policy. The applicable terms will be disclosed during the booking process or in your charter agreement/invoice. You agree to review and comply with the applicable booking terms before paying.
- Non-refundable fees: Certain fees (e.g., processing fees, reservation deposits, or third-party charges) may be non-refundable.
- Weather and safety: Charters may be delayed, modified, rescheduled, or canceled for safety, mechanical, crew, or weather conditions at the operator’s discretion.
- Chargebacks: You agree to contact us first to resolve billing questions before initiating a chargeback, and you authorize us to provide documentation supporting the transaction and booking terms to payment processors.
User accounts and accuracy of information
If you create an account or submit forms on the Site, you agree to provide accurate, current information and to update it as needed. You are responsible for maintaining the confidentiality of any login credentials and for all activities that occur under your account.
Acceptable use
You agree not to misuse the Site or Services. You may not:
- Use the Site for unlawful, harmful, fraudulent, or misleading purposes

- You will only receive SMS if you explicitly opt in via our web forms, booking/quote forms, checkout, or another clear consent method.
- Consent to receive SMS is not a condition of purchase.

Opt-Out & Help
- Reply STOP to unsubscribe at any time. You may receive one final confirmation message.

- Carriers are not liable for delayed or undelivered messages.
SMS Data
We may store your phone number, name (if provided), message content, opt-in/opt-out timestamps, delivery status, and related logs to operate and document our messaging program. We may share limited information with messaging/CRM providers and carriers solely to deliver messages and maintain compliance. We do not sell SMS consent data.
Email marketing and promotional communications
If you opt in to email marketing or provide your email in connection with a quote, booking, or inquiry, we may send you transactional messages (e.g., confirmations, receipts, availability updates) and, if you opt in, promotional messages (e.g., offers, discounts, newsletters). You can unsubscribe from marketing emails at any time using the unsubscribe link in the email. Transactional messages may still be sent as needed to provide the Services.
User content and submissions
You may submit content through the Site (such as form submissions, reviews, comments, photos, or messages) (“User Content”). You represent that you have the rights to submit that content and that it does not violate any law or third-party rights.
By submitting User Content, you grant Champagne Yacht a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute the User Content solely for operating, improving, and marketing our Services (for example: featuring testimonials or charter photos), unless you request removal. We may remove or refuse User Content at our discretion.

Limitation of liability
To the fullest extent permitted by law, Champagne Yacht will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site or Services.
To the fullest extent permitted by law, Champagne Yacht’s total liability for any claim arising out of or relating to the Site or Services will not exceed the amount you paid to Champagne Yacht for the Services giving rise to the claim, or $100, whichever is greater.
Indemnification
